In 2003 Texas passed legislation that essentially eliminated medical malpractice lawsuits. It had such a dramatic effect on the earnings of those who practiced in this area of the law that the lawyers for insurance companies were complaining about the loss of business.
But what has it done to reduce healthcare costs in Texas? Nothing, reports this article by Jennifer S. Bard in the Houston Chronicle.
Doctors have long argued that the threat of malpractice caused them to ask for unnecessary tests and other medical procedures to protect themselves from lawsuits. Seems that Texas doctors who no longer have this excuse are now just pocketing the fees and costs of these extra procedures with no excuse for generating unnecessary medical expenses.
